RWXTEK INC, a California corporation doing business as Loadira ("Loadira," "we," "us," or "our"), is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our website located at loadira.com, our mobile applications, and all related services (collectively, the "Platform").

Loadira operates as a licensed property broker under the authority of the Federal Motor Carrier Safety Administration (FMCSA) with broker authority MC-1781606 and USDOT number 4502922. We provide a technology platform that connects shippers (suppliers) with motor carriers (truckers) for the transportation of freight.

By accessing or using the Loadira Platform, you consent to the collection, use, and disclosure of your information as described in this Privacy Policy. If you do not agree with the terms of this Privacy Policy, please do not access or use the Platform.

We encourage you to read this Privacy Policy carefully and to periodically review it for any changes. Your continued use of the Platform after any changes to this Privacy Policy constitutes your acceptance of such changes.

2. Information We Collect

We collect information in several ways: directly from you, automatically when you use our Platform, and from third-party sources.

2.1 Information You Provide Directly

When you register for an account, post loads, accept shipments, or interact with our Platform, you may provide us with the following information:

  • Account Information: Full name, email address, phone number, mailing address, and password.
  • Business Information: Company name, business address, Employer Identification Number (EIN), website URL, type of goods typically shipped, and average shipment weight.
  • Carrier Credentials: FMCSA Motor Carrier (MC) number, USDOT number, and insurance information.
  • Payment Information: Bank account details for ACH transfers (processed securely through Stripe, our payment processor). We do not store complete bank account numbers on our servers.
  • Identity Verification Documents: Driver's license, business licenses, or other documentation required to verify your identity or business.
  • Communications: Messages sent through our in-app chat feature, customer support inquiries, emails, and any other communications with us or other users.
  • Load Information: Details about shipments you post or accept, including pickup and delivery addresses, commodity descriptions, weights, dimensions, and special handling requirements.

2.2 Information Collected Automatically

When you access or use our Platform, we automatically collect certain information, including:

  • Device Information: Device type, operating system and version, browser type and version, unique device identifiers, and mobile network information.
  • Usage Data: Pages and features you access, actions you take on the Platform, time spent on pages, navigation paths, search queries, and interaction with Platform features.
  • Location Data: For truckers using our mobile application during active loads, we collect precise GPS coordinates to enable real-time shipment tracking. For all users, we may collect approximate location based on IP address.
  • IP Address: Your Internet Protocol (IP) address is collected for security, fraud prevention, and analytics purposes.
  • Log Data: Server logs that record your access to and use of the Platform, including access times, pages viewed, and system activity.

2.3 Information from Third-Party Sources

We may receive information about you from third-party sources, including:

  • Federal Motor Carrier Safety Administration (FMCSA): We verify carrier operating authority, insurance status, and safety ratings through FMCSA's SAFER system and related databases.
  • Stripe: Our payment processor provides verification information related to your bank account for payment processing.
  • Google: We use Google Maps and Google Places for address verification, route calculation, and mapping services.
  • Radar.io: We use Radar for real-time GPS tracking during active loads, geofencing, and location verification.
  • Analytics Providers: We receive aggregated analytics data from services like Google Analytics to understand Platform usage patterns.

3. How We Use Information

We use the information we collect for the following purposes:

3.1 Providing and Improving Our Services

  • To create and manage your account;
  • To facilitate load matching between shippers and carriers;
  • To process transactions and payments;
  • To provide real-time shipment tracking;
  • To maintain and improve the Platform's functionality and user experience;
  • To develop new features and services.

3.2 Verification and Compliance

  • To verify carrier operating authority and insurance status;
  • To verify shipper identity and business information;
  • To comply with FMCSA regulations and record-keeping requirements;
  • To detect and prevent fraud, abuse, and security threats;
  • To enforce our Terms of Service and other policies.

3.3 Communications

  • To send transactional notifications (load updates, payment confirmations, delivery status);
  • To respond to your inquiries and provide customer support;
  • To send service-related announcements and administrative messages;
  • To send marketing communications (with your consent, where required by law).

  • To analyze Platform usage and trends;

4. Information Sharing

We may share your information in the following circumstances:

4.1 With Other Platform Users

To facilitate freight brokerage services, we share certain information between shippers and carriers:

  • Shippers can see: Carrier company name, MC and DOT numbers, insurance status, safety rating, driver name (for active loads), and real-time location during active shipments.
  • Carriers can see: Shipper company name, pickup and delivery addresses, contact information for active loads, and load details.

This information sharing is necessary to facilitate the brokerage relationship and shipment completion.

4.2 With Service Providers

We share information with third-party service providers who assist in operating our Platform:

  • Stripe: Payment processing and bank verification.
  • Google: Maps, geocoding, and address verification services.
  • Radar.io: Real-time GPS tracking and geofencing.
  • Firebase/Google Cloud: Cloud hosting, database, and authentication services.
  • Analytics providers: Platform usage analytics.
  • Customer support tools: Help desk and communication platforms.

These service providers are contractually obligated to use your information only for the purposes of providing services to us and must maintain appropriate security measures.

4.3 With Government and Regulatory Authorities

We may share information with government agencies, including:

  • FMCSA: For carrier verification and regulatory compliance.
  • Law enforcement: In response to valid legal process or when required by law.
  • Tax authorities: As required for tax reporting (e.g., 1099 forms for carriers).

4.4 Business Transfers

If Loadira is involved in a merger, acquisition, sale of assets, bankruptcy, or other business transaction, your information may be transferred as part of that transaction. We will notify you via email and/or prominent notice on our Platform of any change in ownership or uses of your personal information.

4.5 What We Do NOT Do

  • We do NOT sell your personal information to third parties for their marketing purposes.
  • We do NOT share your personal information with unrelated third parties for their independent marketing purposes.
  • We do NOT share your information with data brokers or advertisers for targeted advertising on other platforms.

5. Data Retention

We retain your information for as long as necessary to fulfill the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law. The following retention periods apply:

When you request deletion of your account, we will delete or anonymize your personal information within thirty (30) days, except for information we are required to retain for legal, regulatory, or legitimate business purposes as described above.

The transmission of information via the internet is not completely secure, and we cannot guarantee the security of your data transmitted to our Platform. Any transmission of personal information is at your own risk.

7.1 Rights for All Users

Regardless of your location, you have the following rights with respect to your personal information:

  • Deletion: You may request that we delete your personal information, subject to certain exceptions (such as legal retention requirements).
  • Opt-Out of Marketing: You may opt out of receiving marketing communications from us at any time by clicking the "unsubscribe" link in any marketing email or by contacting us.

  • Right to Opt-Out of Sale: You have the right to opt out of the "sale" of your personal information. Loadira does not sell personal information as defined by the CCPA/CPRA.
  • Right to Non-Discrimination: We will not discriminate against you for exercising any of your privacy rights.
  • Right to Correct: You have the right to request correction of inaccurate personal information.
  • Right to Limit Use of Sensitive Personal Information: You have the right to limit our use of sensitive personal information to purposes necessary to provide our services.

Authorized Agents: You may designate an authorized agent to make requests on your behalf. We may require verification of your identity and the agent's authority before processing such requests.

8.1 What Are Cookies?

Cookies are small text files that are stored on your device when you visit a website. They help websites remember your preferences and improve your user experience.

8.2 Types of Cookies We Use

  • Essential Cookies: These are necessary for the Platform to function properly. They enable core functionality such as authentication, security, and session management. You cannot opt out of essential cookies.
  • Analytics Cookies: These help us understand how users interact with our Platform, which pages are most popular, and how users navigate through the site. We use Google Analytics for this purpose.

Note: Disabling cookies may affect the functionality of our Platform. Some features may not work properly if you disable essential cookies.

8.4 Do Not Track

Some web browsers have a "Do Not Track" feature that signals to websites that you do not want to be tracked. Currently, there is no industry consensus on how to respond to these signals, and our Platform does not currently respond to "Do Not Track" signals.

10. Children's Privacy

Our Platform is not intended for individuals under the age of eighteen (18). We do not knowingly collect personal information from children under 18.

If you are a parent or guardian and believe that your child has provided us with personal information without your consent, please contact us immediately at customertek@rwxtek.com. If we become aware that we have collected personal information from a child under 18, we will take steps to delete that information promptly.

Use of the Loadira Platform requires the ability to enter into legally binding contracts, which typically requires users to be at least 18 years old.

11. International Users

Loadira is headquartered in the United States, and our Platform is primarily designed to serve users in the United States. If you access our Platform from outside the United States, please be aware that your information will be transferred to, stored, and processed in the United States.

By using our Platform, you consent to the transfer of your information to the United States and the use and disclosure of your information in accordance with this Privacy Policy and applicable U.S. law.

The data protection laws of the United States may differ from those of your country of residence. We take appropriate measures to ensure that your personal information receives an adequate level of protection in accordance with this Privacy Policy.

12. Location Data (Truckers)

This section provides additional information specifically about our collection and use of location data from truckers using the Loadira mobile application.

12.1 When We Collect Location Data

GPS tracking is activated when a trucker has an active load in progress (from acceptance through delivery confirmation). Location tracking is not active when you are not on an active load.

12.2 Purpose of Location Tracking

Location data is essential for providing our services and is used for the following purposes:

  • Real-Time Shipment Tracking: Enables shippers to see the current location of their freight;
  • ETA Calculation: Provides estimated arrival times to pickup and delivery locations;
  • Detention Verification: Calculates time spent at pickup and delivery locations for detention pay purposes;
  • Proof of Delivery: Verifies that delivery occurred at the correct location;
  • Safety and Security: Assists in locating freight in case of emergencies or disputes;
  • Route Optimization: Helps identify efficient routes for future loads.

12.3 Who Can See Your Location

  • Shipper for Your Load: The shipper whose load you are transporting can see your real-time location during that specific shipment only.
  • Loadira Staff: Our support and operations team may access location data to assist with load tracking, disputes, or customer support issues.

Shippers can only see location data for their own active loads. They cannot see your location when you are not transporting their freight.

12.4 Disabling Location Tracking

You can disable location permissions for the Loadira app through your device settings. However, please note that:

  • You cannot accept new loads without location permissions enabled;
  • Disabling location during an active load may result in strikes or payment holds;
  • Location tracking is a required feature for platform functionality.

12.5 Location Data Retention

GPS tracking data is retained for one (1) year after the delivery date. This data may be used for:

  • Resolving cargo claims or disputes;
  • Verifying detention time claims;
  • Responding to legal requests;
  • Improving our services.

13. Changes to Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or other factors. When we make changes, we will:

  • Update the "Last Updated" date at the top of this Privacy Policy;
  • Post the revised Privacy Policy on our Platform;
  • For material changes, notify registered users via email and/or prominent notice on the Platform;
  • Where required by law, obtain your consent to the changes.

Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the revised Privacy Policy. If you do not agree with the revised Privacy Policy, you should discontinue use of the Platform.
